Period of Consultations: Wed May 22, 2024 to Thu October 31, 2024IN EXERCISE of the powers conferred on the National Information Technology Agency (NITA) under the National Information Technology Act 2008 (Act 771) to regulate information communications technology and related purposes, the Agency hereby makes the following regulations
These Regulations shall be known as the Regulations for Data Centre Services and shall come into force on the date of publication in the Gazette
Key Provisions / Thematic Areas
The objectives of these Regulations are to:
- Increase investment by creating a business-friendly environment through a transparent, streamlined registration process, light touch regulations and tax incentives;
- Encourage industry, voluntary adoption of international standards as means to develop a regional digital centre of excellence through world class Data Centre facilities and services;
- Foster cross sector government collaboration as a means to support a holistic regulatory framework for the Data Centre market that addresses data privacy and security, quality electronic communications services, cybersecurity, fire safety, access to renewable energy among other cross-sector issues that impact the market ;
- Promote fair competition and customer satisfaction by requiring non-discriminatory, open access to Data Centres and Cloud Computing Services and fair business practices through transparent terms and conditions;
- Support ICT training and development to develop a cadre of local ICT professionals; and
- Monitor, enforce and ensure effective compliance with these Regulations.
