Mortgages Act, 1972 N.R.C.D. 96
Section 4:
(1) A mortgage is effectual to create a charge on the interests and rights which the mortgagor has in the property mortgaged, or which the mortgagor enjoys as an incident of the interest in the mortgaged property.
(2) Subsection (1) applies only if and as far as a contrary intention does not appear expressly or by necessary implication, and has effect subject to the mortgage.
