Minerals and Mining (Licensing) Regulations 2012 (LI 2176)
Regulation 158.
(1) The holder of a prospecting licence who wishes to surrender all or part of the land which is the subject matter of the licence shall apply to the Commission for a Certificate of Surrender as set out in Form Thirty-Nine of the First Schedule not later than sixty days before the date on which the holder wishes the surrender to take effect.
(2) The application for surrender shall include
(a) the cadastral coordinates or code in respect of the area to be surrendered;
(b) reasons for the surrender;
(c) a list of all the reports submitted to the Commission since the grant of the licence;
(d) an up-to-date report on the activities conducted on the area to be surrendered since the submission of the last report; and
(e) evidence of payment of the applicable fees.
Procedure to Follow
Submit Your Application
Once you have filled and gathered all the required documents you will have to submit it at the district office.
It takes 5 days to review the application. The next 5 days is for notification of errors.
Submission To Mineral Titles Department (MTD)
10 days after registration, the district office shall submit the application to MTD.
MTD review the application in 10 days and records it in the priority register
MTD Publishes In The Gazette
15 days after recording, MTD publishes in the gazette, notify chiefs, traditional authorities etc. through the Commission's District Offices.
Application Dossier
Within ten (10) days after publication, District Office shall submit application dossier to MTD for appropriate recommendation to Minister
Minister Takes Decision
Once you have completed these steps you are ready to start your business.
You need to renew your license every three (3) years.
Approval / Rejected
21 days notification to applicant and Fees payable if approved.
Reasons are given if rejected.
Applicable Fees
Within 60 days, applicant pays applicable fees and gives notice of acceptance of the grant to Minister and Commission in writing.
License
Minister on proof of payment of applicable fees, issues licence to applicant within 30 days after the date of acceptance of the grant....
