Regulation 189
(1) A holder of a mining lease may not later than ninety days before the expiration of the term of the lease, apply to the Commission as set out in Form Forty-Seven of the First Schedule for extension of the term of the lease in respect of all or part of the area which is the subject matter of the lease.
(2) The application shall include
(a) a certified copy of the mining lease;
(b) the cadastral co-ordinates delineating the area that is the subject matter of the application for extension in the case of reduction in the perimeter of the original polygon;
(c) a comprehensive technical and financial report in respect of the expired term and a programme of mining operations for the proposed extension, including financial particulars, prepared according to the Commission's guidelines;
(d) annual reports of the applicant for the previous two years, including audited accounts;
(e) particulars of the qualifications and experience of the manager and other members of the technical team in charge of the mining operations, in case of a change in the team;
(f) particulars of the applicant's proposals with respect to the employment and training in the mining industry of Ghanaians;
and
(g) evidence of payment of the applicable fees.
Procedure to Follow
Submit Your Application
Once you have filled and gathered all the required documents you will have to submit it at the district office.
It takes 5 days to review the application. The next 5 days is for notification of errors.
Submission To Mineral Titles Department (MTD)
10 days after registration, the district office shall submit the application to MTD.
MTD review the application in 10 days and records it in the priority register
MTD Publishes In The Gazette
15 days after recording, MTD publishes in the gazette, notify chiefs, traditional authorities etc. through the Commission's District Offices.
Application Dossier
Within ten (10) days after publication, District Office shall submit application dossier to MTD for appropriate recommendation to Minister
Minister Takes Decision
Once you have completed these steps you are ready to start your business.
You need to renew your license every three (3) years.
Approval / Rejected
21 days notification to applicant and Fees payable if approved.
Reasons are given if rejected.
Applicable Fees
Within 60 days, applicant pays applicable fees and gives notice of acceptance of the grant to Minister and Commission in writing.
License
Minister on proof of payment of applicable fees, issues licence to applicant within 30 days after the date of acceptance of the grant....
