1 In addition to any other sanctions imposed by law, COCOBOD shall have the right to withdraw the licence of any company upon breach of any of the LBC obligations contained herein. COCOBOD reserves the right to carry out a mandatory inspection as and when necessary for this purpose.
9.2 COCOBOD shall have the right to withdraw the licence of any company for failure to oerate for two consecutive crop years.
9.3 Any company whose licence is withdrawn may re-apply for registration and licensing after one crop year.
9.4 Where a company fails to handle aminimum volume of2,000 metric tonnes as required under 1.1.2 (ii) for three consecutive cocoa years, the licence shall be suspended until the company can demonstrate its ability to meet the minimum requirements.
9.5 Where a company is warned for three (3) consecutive cocoa years for performing below average, the licence shall be suspended until the LBC can demonstrate its ability to meet its obligations under these regulations.
9.6 LBCs who are involved in irregular withdrawals would be subject to a penalty of 25% of the value of the produce withdrawn at the first instance, 40% at the second and a withdrawal ofthe dealer's licence at the third instance.
