National Pensions Act,2008 (Act 766)

Section 129: (1) An application for the registration of an occupational pension or provident fund scheme as an
employer sponsored scheme may be made to the Board only by
(a) a company which has been approved as a trustee or has applied for approval as a trustee;
(b) two or more individuals who are approved trustees, or have applied for approval and at least
one is an independent trustee; or
(c) a company and one or more individuals.
(2) An application for the registration of an occupational pension or provident fund scheme as a
master trust scheme shall be made to the Board by an approved trustee that is a company or by a company
that has applied for and been granted a licence under this Act.
(3) If an application is made by two or more approved trustees who are individuals, at least one of
them must be an independent trustee.
(4) The Board may by regulations prescribe the qualifications of independent trustees for the purpose
of this subsection.
