Minerals and Mining (Licensing) Regulations 2012 (LI 2176)
Regulation 240.
(1) Where the applicant provides the information required under regulation 239, the District Office of the Commission shall record in the General Register, the details of the application including the date, hour and minute the application was submitted.
(2) An application shall not be recorded in the General Register unless the information required under regulation 239 is provided by the applicant.
(3) Where an application is recorded in the General Register, the District Office of the Commission shall transfer the information submitted by the applicant onto an Application Certificate, as set out in Form Two of the First Schedule which shall be signed by the applicant and the District Officer.
(4) Where an application is recorded in the General Register, the District Office of the Commission shall plot the area corresponding to the proposed merger as a provisional polygon on the cadastral map.
(5) The original polygons corresponding to the licences yet to be merged shall remain valid until the application for the merger is granted.
Procedure to Follow
Submit Your Application
Once you have filled and gathered all the required documents you will have to submit it at the district office.
It takes 5 days to review the application. The next 5 days is for notification of errors.
Submission To Mineral Titles Department (MTD)
10 days after registration, the district office shall submit the application to MTD.
MTD review the application in 10 days and records it in the priority register
MTD Publishes In The Gazette
15 days after recording, MTD publishes in the gazette, notify chiefs, traditional authorities etc. through the Commission's District Offices.
Application Dossier
Within ten (10) days after publication, District Office shall submit application dossier to MTD for appropriate recommendation to Minister
Minister Takes Decision
Once you have completed these steps you are ready to start your business.
You need to renew your license every three (3) years.
Approval / Rejected
21 days notification to applicant and Fees payable if approved.
Reasons are given if rejected.
Applicable Fees
Within 60 days, applicant pays applicable fees and gives notice of acceptance of the grant to Minister and Commission in writing.
License
Minister on proof of payment of applicable fees, issues licence to applicant within 30 days after the date of acceptance of the grant....
