Dam Safety Regulations, 2016, L.I. 2236
Regulation 28
(1) The owner of a dam or the operator of a dam shall not abandon a dam unless the owner or operator decommissions the dam in accordance with these Regulations.
(2) An owner of a dam or the operator of a dam who contravenes subregulation (1) commits an offence and is liable on summary conviction to a fine of not less than five hundred penalty units and not more than seven hundred and fifty penalty units or to a term of imprisonment of not less than one year and not more than two years or to both the fine and the imprisonment and to the cost of decommissioning the dam.
