Trade Marks Act, 2004 (ACT 664)

Section 12: (1) The High Court shall invalidate the registration of a trade mark if the person requesting the invalidation proves that section 1 or any requirement of section 4 has not been complied with. (2) The court may invalidate the registration of a trade mark if because of any act or inactivity of the owner, it has become the common name in the trade for goods or services for which it is registered. (3) The invalidation of the trade mark is effective from the date of registration. (4) The Registrar shall record the invalidation and publish the invalidation as soon as possible.
