Trade Marks Act, 2004 (ACT 664)

Section 13: The High Court shall invalidate the registration of a collective mark if the person requesting the invalidation proves that (a) only the registered owner uses the trade mark to the exclusion of other enterprises; (b) the registered owner permits the use of the trade mark in contravention of the regulations of the collective mark; or (c) the registered owner uses or permits the use of the trade mark in a manner likely to deceive trade circles or the public as to the origin or any other common characteristics of the goods or services concerned.
