The safe, secure, and peaceful use of nuclear materials and radioactive materials is of greatest importance to national interest, public health, environmental protection, and international obligations. This is because nuclear activities ought to be conducted safely and securely, to  protect the people, the environment and properties from the harmful effects of radiation hazards, whilst enjoying its benefits.

The Emergency Preparedness and Response for Authorised Persons Regulations are crucial for the safety and security of the public, the environment, and nuclear facilities. They ensure that authorized persons (those with specific roles and responsibilities in nuclear facilities) are equipped to effectively manage and respond to potential nuclear or radiological emergencies. These regulations define the requirements for an adequate level of preparedness and response, including mitigation of consequence.

These regulations provide procedures for coordinating efforts, mobilizing resources, and providing assistance during a nuclear or radiological emergency. Key aspects include risk assessment, developing plans, training personnel, ensuring adequate infrastructure and having the necessary human resource.

Key Provisions / Thematic Areas

Key provisions:
1.      Need to establish procedures for the appropriate management of operations in response to a nuclear or radiological emergency.
2.      Preparing organizations and individuals to respond to potential nuclear or radiological emergencies, which may be initiated by natural disasters or Acts of God. 3.      Have the necessary resources, including financial and material support to be mobilized and managed during an emergency to address the needs of the affected population.
4.      Provision of procedures for identifying, assessing, and mitigating risks.
5.      Establish accountability for actions taken during an emergency, which is essential for ensuring that response efforts are effective and that lessons learned are implemented to improve future preparedness and response capabilities.
6.      Establish clear lines of authority and communication channels to ensure that authorized personnel can effectively coordinate response efforts with other relevant stakeholder institutions.
7.      Description and criteria for emergency preparedness categories.
8.      Reporting to the International Atomic Energy Agency and other regional and international agencies.
9.      Penalties for flouting any of the provisions of these Regulations.
10.  Appeals may be made in accordance with the procedures provided in the Nuclear Regulatory Authority Act, 2015.
