It is a core mandate of the Nuclear Regulatory Authority to develop regulations that licensees must meet to obtain or retain a license or certificate to use nuclear materials or operate a nuclear facility. These draft regulations provide specific guidance and implementation details for the broader regulatory framework outlined in the Nuclear Regulatory Authority Act, 895 of 2015. These regulations ensure consistent and effective enforcement of safety, security, and other standards related to nuclear activities.

These regulations are necessary for ensuring the safety and security of these facilities. It provides a framework for the design, construction, and operation of nuclear installations. It also provides the framework for the manufacture of components vital to their safe operation. They help to establish clear standards, ensure compliance, and promote public confidence in nuclear activities.

The Licensing Regulations for Nuclear Installations and Manufacturers of Safety Class Equipment and Components in Ghana provides the specific conditions for nuclear power site licensing, covering aspects like design, construction, operation, and decommissioning.  This is to ensure the safe operation and management of nuclear facilities throughout their lifecycle, from design and construction to decommissioning.

Key Provisions / Thematic Areas

Key provisions:
1.      Compliance with national legislations, regulations, and technical standards as agreed with the Nuclear Regulatory Authority to ensure the safety and security of the nuclear installation.
2.      Establishment and provision of the procedures for obtaining the necessary permits and authorizations for different stages of a nuclear installation's life cycle, including construction, operation, and decommissioning.
3.      Ensuring the presence and availability of qualified personnel to carry out the licensed activity in a safe, secure and sustainable manner.
4.      Establishment of specific requirements for the design, construction, and materials used in nuclear installations, ensuring that they meet stringent safety standards.
5.      Provision for the manufacture of components deemed critical to safety, including those that can impact the safe operation of the nuclear installation.
6.      Provision for quality assurance requirements and the need for robust processes and controls to ensure the quality and reliability of equipment and components. 7.      Provision for the oversight and enforcement of these standards by the Nuclear Regulatory Authority.
8.      Addressing the need for emergency preparedness and response planning to mitigate the potential consequences of any nuclear or radiological incident, accidents or fire outbreak.
9.      Implementation of international licensing guidelines and standards set by organizations like the International Atomic Energy Agency.
10.  Penalties for flouting any of the provisions of these Regulations.
11.  Appeals may be made in accordance with the procedures provided in the Nuclear Regulatory Authority Act, 2015
